EXECUTIVE ORDER NUMBER 43

WHEREAS, reliable, low-cost energy is critical to Alabama industries’ competitiveness and economic growth;

WHEREAS, industries account for approximately 40 percent of total energy consumption in Alabama;

WHEREAS, the efficient use of energy and voluntary implementation of energy efficiency measures can reduce industrial energy costs and contribute to the sustainability of Alabama industries;

WHEREAS, Alabama industries can direct energy efficiency savings toward new jobs and innovation;

WHEREAS, a large number of organizations and state and federal agencies are involved in energy efficiency activities and programs;

WHEREAS, the Energy Division of the Alabama Department of Economic and Community Affairs (“ADECA Energy Division”) serves as the State Energy Office and is responsible for maintaining the State’s energy programs;

WHEREAS, a coordinated action plan on industrial energy efficiency with input from key stakeholders can enhance opportunities for existing and future Alabama industries; and

WHEREAS, a proposed Alabama Action Plan for Industrial Energy Efficiency (“Action Plan”) was presented to the Governor following the Alabama Policy Academy on Industrial Energy Efficiency in 2013.

NOW, THEREFORE, based upon these considerations, and for other good and valid reasons relates thereto, I, Robert Bentley, Governor of the State of Alabama, by virtue of the authority vested in me by the Constitution and laws of the State of Alabama, do hereby establish the Alabama Industrial Energy Advisory Team (“Advisory Team”). The Advisory Team is created to advance selected key priorities identified in the Action Plan.

BE IT ORDERED, that the ADECA Energy Division representative shall chair the Advisory Team. It shall be the duty of the ADECA Energy Division to call, organize, and conduct meetings in accordance with the Advisory Team’s adopted operating procedures.

The Advisory Team shall consist of one representative from the following organizations:

1. ADECA Energy Division;
2. Manufacture Alabama;
3. Alabama Industrial Energy Consumers;
4. Alabama Power;
5. PowerSouth Energy Cooperative;
6. Tennessee Valley Authority;
7. Alabama Municipal Electric Authority;
8. Alabama Rural Electric Association;
9. Alagasco;
10. Alabama Natural Gas Association;
11. Business Council of Alabama;
12. National Federation of Independent Business – Alabama;
13. Partnership for Affordable Clean Energy;
14. EDT Energy;
15. Governor’s Office; and
16. Additional members as the Governor deems necessary.

BE IT FURTHER ORDERED, that all representatives shall be approved by the Governor.

BE IT FURTHER ORDERED, that members of the Advisory Team shall establish procedures relating, but not limited, to meeting schedules, agendas, the establishment of committees, and the manner of conducting business. The Advisory Team, and any committees of the Advisory Team, may meet via teleconference.

BE IT FURTHER ORDERED, that members of the Advisory Team shall not receive compensation, subsistence allowance, mileage, or associated expenses, except as expressly stated herein. Officials or employees of State agencies who are appointed and designated to Advisory Team shall be allowed to participate in the Advisory Team as part of their duties and may claim per diem, mileage, or associated expenses as allowed by law.

BE IT FURTHER ORDERED, that the Advisory Team, under the leadership of the ADECA Energy Division, shall maintain and update the Action Plan in a manner that is consistent with this Executive Order. The Advisory Team shall provide a progress report to the Governor on the Action Plan at the end of each calendar year and upon request.

BE IT FURTHER ORDERED, that the ADECA Energy Division shall administer any funds received through government or pivate grants or appropriated by the LEgislature to the ADECA Energy Division for the implementation of the Action Plan.

BE IT FURTHER ORDERED, that this Executive Order shall become effective immediately upon signing and shall remain in force until such time as it is modified or rescinded by the Governor.
